New York residential lease

New York residential lease agreement

Prepare a free residential lease for a New York home outside New York City, rented for at least 30 days. Download the PDF, or have the landlord and each tenant sign it here.

What the New York form covers

  • The home, the people, the rent, the deposit, and the house rules.
  • Whether the building has a sprinkler system, whether the home is in a FEMA special flood hazard area, and whether flood damaged it before.
  • A late fee only after rent has been unpaid for five days, and not more than $50 or 5 percent of the monthly rent, whichever is less.
  • A security deposit, including a pet deposit, of one month's rent.
  • The federal lead warning when the home was built before 1978.

What this form will not prepare

  • New York City, including Brooklyn, Queens, the Bronx, Manhattan, and Staten Island, is not prepared on this form. A rent-stabilized home, or a home covered by a local good-cause law, stops as well.
  • Subsidized housing, a stay under 30 days, rent-to-own, a stay tied to a home sale, a mobile-home park, a room in the owner's home, commercial space, and submetered utilities are outside this form.

This is a residential lease template. It is not legal advice, and it is not a law firm.

When the answers are complete, download the lease or send it to the landlord and each tenant. The lease is marked signed only after every one of them has signed.

Questions

Does this New York lease cover New York City?

No. New York City addresses, rent-stabilized homes, and homes covered by a local good-cause law are not assembled.

How does the New York late fee work?

The form does not add a late fee unless rent is still unpaid after five days. The fee cannot be more than $50 or 5 percent of the monthly rent, whichever is less.
